PRIVACY NOTICE

By registering for this Congress, you expressly consent that the FONDO DE GARANTÍA DE DEPÓSITOS DE ENTIDADES DE CRÉDITO (FGD), as Data Controller, may process your personal data for the purpose of managing your participation in the event. It may be necessary to communicate your personal data to the European Forum of Deposit Insurers (EFDI) for attendance control and to third party organizers belonging to the travel, hospitality or leisure sector. The basis for the processing is your consent.

Additionally, you authorize the FGD to capture images of your person, in photography or video during the events related to the Congress, as well as to use the aforementioned material for dissemination and/or publication for corporate advertising purposes of the Congress on the FGD website (https://www.fgd.es) and on the social networks/channels used by the FGD (LinkedIn, X, Vimeo and Youtube), reserving the right to withdraw your consent at any time. In compliance with the duty of information established in Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, the provider company informs you that www.efdi2025madrid.eu is an online platform (hereinafter, the ‘Platform’) that acts as an information and registration point for the ‘EFDI Annual General Meeting and International Conferences’ to be held in Madrid from 3 to 6 June 2025, inclusive (hereinafter, the ‘Event’) and its corresponding services (accommodation, complementary activities, etc.).

The technical organisation of the Event and the management of the Platform is carried out by “Viajes El Corte Inglés, S.A.” (hereinafter, the ‘Organiser’), with tax identification number A28229813, registered office at Avda. de Cantabria nº 51, Madrid (28042) and contact e-mail address: [*], contracted for this purpose by the “Fondo de Garantía de Depósitos de Entidades de Crédito” (hereinafter, the ‘FGD’)).

PREAMBLE

Before using the services offered by the Organiser, the User must read and accept these Terms and Conditions.

These Terms and Conditions (hereinafter, the ‘T&C’) govern the use and access to the Platform, as well as to the App, available for iOS and Android, owned by the Organiser, which may be enabled.

Acceptance of these T&Cs implies a binding contractual relationship between you and the Organiser.

Please note that access to the Platform implies knowledge and acceptance of the following T&Cs. Furthermore, by registering as a User, you agree to abide fully by this agreement and acknowledge that you are fully informed of all the provisions contained therein. If you do not accept all the terms included in the T&Cs, you will not be able to continue with the contracting process and will not be able to make use of the services offered by the Organiser.

These rules have been adopted in accordance with the legislation in force in order to guarantee the freedom of the Users and a quality Internet service.

By accepting these conditions, Users give their express consent to the processing of their personal data in accordance with the provisions of article 6 of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Digital Rights.

Likewise, all registered Users guarantee that all personal data provided are accurate, truthful and undertake to inform the Organiser of any changes or modifications thereto.

The Organiser reserves, but is not obliged to do so, the right to request any official information to verify the veracity of the personal data provided.

In the event that a registered User provides false, inaccurate or incomplete data or, if the Organiser has reasonable grounds to doubt their veracity, access to use the Platform may be denied and all contracts may be cancelled without prejudice to the right to take appropriate legal action.

DEFINITIONS

Organiser: Service provider responsible for managing the Platform, i.e. Viajes El Corte Inglés, S.A., with Tax Identification Code A28229813 and registered office at Avda. de Cantabria nº 51, Madrid (28042).

T&C: Conditions of use established by this contract applicable, without restriction or limitation, to all the services offered by the Organiser.

User Account: Basic services (profile, Email) that allow the User to have an identity on the Platform and to interact.

Services: Refers to the set of services, paid or free of charge, available to Users on the Platform.

User: Internet user over 18 years of age who has accepted these T&C and who makes use of the Platform.

GENERAL TERMS AND CONDITIONS

1. Purpose of this agreement

The Platform is the information and registration point for the Event.

In order to register for the services offered by the Organiser, Users must complete the registration and/or subscription process. Users will be able to access from the Website.

Users who have not accepted this contract and completed all information fields will not be able to continue with the registration process. Completion of the registration process implies for all purposes the acceptance of the offer made available by the Organiser and the conclusion of the contract.

The Organiser archives the contractual data, including these T&Cs. Users can read and find the T&Cs on the website, where an updated version will be published at all times. The data requested when registering for the registration for the Event or ancillary services shall be the identity and contact data, the job title and in case of purchase also the financial data, depending on the chosen payment method.

2. Conditions of access

2.1 User requirements

The User must have the legal capacity to contract in accordance with the Spanish Civil Code. In addition, in order to use the Platform, the User must fully and expressly accept the T&Cs.

Likewise, every Registered User guarantees that the personal data provided to the Organiser are true and accurate and undertakes to communicate any change or modification thereof.

The Organiser does not have the technical and/or legal means to verify the veracity of the identity claimed by Users and cannot be held responsible for the accuracy or inaccuracy of the data provided.

However, if doubts arise as to the accuracy of the information provided by the User, or in the event that third parties or other users communicate information relating to impersonation or the sending of false information about identity, The Organiser may:

- Deny the User access to the account, or

- Require the User to provide valid legal proof of identity.

In the event that the User fails to provide such proof within 8 days, or if it is established that there has been identity theft or that false information has been submitted that is detrimental to third parties, the User will be liable for violation of the T&C and the contract may be legally terminated.

2.2 Registration form

It is mandatory to successfully complete the registration process and, in particular, to fill in the relevant form in order to be able to use the Platform and to establish the contractual link with the Organiser.

The Application may request Users to submit the following information:

e-mail address

City and country

Place of work

2.3 User account

Provided that a User fulfils all necessary registration requirements, a user account will be provided. Users will be able to access their account by entering their personal password and chosen identifier. This information must be strictly personal and confidential.

Users are solely responsible for the correct use and safekeeping of their registration information. The Organiser cannot be held responsible for the extravagance or appearance of these identification elements by third parties nor for the actions or statements made by Users during the use of their accounts.

The equipment (hardware, software, etc.) and communication costs necessary to access the services shall always be borne by the User.

The use of third-party names or entities is prohibited. The same applies to the use of names or trademarks; or the use of offensive, vulgar and obscene names.

2.4 Management of the User's account

Users, by accessing their Account with the name and password provided during registration, will be able to manage all operations relating to the services offered.

Users may consult and/or modify their personal information linked to their personal Account at any time.

All of the User's operations will appear in his or her personal Account for permanent consultation.

2.5 Cancellation of the User Account

Users are free to cancel their Account at any time. The right is reserved to suspend or terminate access to the Services, in case of non-compliance with the T&Cs or following malicious use of the Services.

Users may request the deletion of their personal data by attaching a valid legal identification for identity verification purposes.

3. Contracting process

3.1 Registration

In order to access the services offered by the Organiser, it will be necessary for the User to register, for which his/her personal data will be collected. The User declares to accept and understand that in order to access the services offered it is necessary to provide the required data. The User provides all data freely and voluntarily and expressly authorises the processing of the data provided in order to carry out the service contracted with the Organiser, the FGD and third party service providers in the travel, hospitality or leisure sector of the Event.

3.2 Protection, collection and processing of the user's personal data

The Organiser declares that the personal data provided by the User will always be processed in accordance with the relevant regulations in force. With special observance of the LO 3/2018, of 5 December, Regulation (EU) 2016/679 of 27 April 2016 and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.

By accepting the T&C, the User expressly and unequivocally consents to the processing of all personal data provided for the purpose of providing the contracted services.

By installing and using the Platform, the User agrees that the Organiser collects, uses, records and stores information related to the User's user settings, software and hardware attributes, IP addresses, location, connection errors and interaction. The Organiser may use this information to improve the configuration and performance of the Platform/application by default.

The User may exercise his/her rights of access, rectification, opposition and cancellation at any time by communicating this request and attaching a valid legal identification to indicating in the subject line ‘Request to exercise rights relating to data protection’.

The User authorises the Organiser and the FGD, acting as ‘Data Controller’, to process all data submitted. In addition, the User's express consent will be requested during the Event registration process for the transfer of data to service providers of the Event belonging to the travel, hotel or leisure sector, as well as for the transfer of his/her image to the FGD for corporate advertising purposes of the Event.

4. Obligations and responsibilities of the User

4.1 Obligations of the User

- To make truthful declarations.

- Comply with current regulations and not infringe public order.

- To respect Intellectual and/or Industrial Property rights.

- Not to impair in any way the operation of the services offered by the Organiser.

- Not to disseminate or disclose the content of the communications and messages sent to Users by the means of the service.

4.2 Responsibility of the User

Users are solely responsible for the use of the data they consult, request or communicate through their account.

Users undertake to hold harmless and, where appropriate, indemnify the Organiser against any penalty, fine, compensation, damage or prejudice arising from any claim of any kind or nature that may arise directly or indirectly from the legal and/or contractual obligations arising from these T&Cs.

5. Obligations and responsibilities of the Organiser

5.1 Obligations of the Organiser

The Organiser undertakes to provide an online service in accordance with the law.

5.2 Responsibilities of the Organiser

The Organiser shall not be held responsible in case of fraud, identity theft or other crimes, nor shall it be held responsible for any attack on the image or privacy committed by Users through the Platform/application.

In general, the Organiser is not responsible for the information provided by Users, nor for its veracity, authenticity or accuracy, provided directly or through other means of subscription.

The Organiser will store the contents that may be related to possible infringements in order to communicate them to the judicial authorities. Likewise, it will keep the data of Users who unsubscribe in compliance with current regulations on the protection of Personal Data or any other applicable regulations.

The Organiser does not guarantee the functioning of the services in the event of interruption of the User's Internet access or in the event of non-functioning or poor access conditions caused by the blocking of the Internet network or any other cause of force majeure, not attributable to the Organiser or its suppliers.

The Organiser cannot guarantee that its systems are infallible and error-free. In this sense, neither can it guarantee that the results of the use of these services will meet the User's expectations.

6. Intellectual property rights

6.1 Rights of the Organiser

The contents relating to brands, domains, logos, drawings or documentation, including all types of software, computer programs, or any element susceptible of protection by the legislation on Industrial and/or Intellectual property, to which Users and participants of the Event may have access, are the property of the provider and all rights of use of the same are expressly reserved.

Users may only use said material exclusively in the manner authorised by the owner.

Any misuse of the service or breach of the User's obligations may result, at the discretion of the Organiser, in the cancellation of the account and/or suspension of the contracted services until the incident is resolved.

The Organiser is not the owner of the rights to third party trademarks that may appear in advertising inserts within the Platform. The User undertakes not to infringe possible rights related to intellectual and industrial property and shall avoid endangering their integrity. Failure to comply with the above will lead to the adoption of legal measures.

7. Modification of the T&C

The Organiser shall have the right to modify, at any time and without prior notice, the T&C in order to adapt them to new legislation or jurisprudence as well as to changes or practices in the economy or the sector, taking into account at all times the legitimate interests of the Users, and the User must periodically consult these T&C in order to check or ensure the existence of modifications or changes in the same, taking as a reference the date of the last update. All of the above without prejudice to the fact that changes to contracts already signed are not affected.

8. Applicable law

In accordance with the provisions of Article 23 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, contracts concluded electronically such as the present one will be fully effective and are provided for in the legal system, provided that consent and the other requirements for their validity are met.

These T&C are available to all Users free of charge. Access to the contracting process is completely free of charge, with no additional costs associated with it, except for the customer's own Internet connection.

The contracting is considered to be completed once the User clicks on the ‘I accept’ button, it being understood that following all the phases of the electronic contracting procedure and the inclusion of all the data requested, together with the final express acceptance of these conditions, is a clear and direct manifestation of the client's will to accept the T&Cs. The Organiser, as a provider of Information Society services, will store the electronic document formalising this contract on a durable medium. This electronic document will be accessible via the link provided to the User in the printable confirmation email.

9. Jurisdiction

For the resolution of disputes or questions related to these T&C, Spanish law shall apply, to which the parties expressly submit. In the case of civil contracts, when one of the contracting parties acts as a CONSUMER, the specific regulations for the Defence of Consumers and Users shall apply.

Consumers and Users may resolve any dispute before the competent Court according to their place of residence or that of the registered office of Viajes El Corte Inglés, S.A. In the event that Viajes El Corte Inglés, S.A. is the party initiating legal action against a consumer, the Courts of the jurisdiction of the consumer's place of residence shall have jurisdiction.

In all cases of commercial contracts, the parties agree to submit to the commercial jurisdiction of the Courts and Tribunals of Madrid.

10. Partial invalidity

If any clause of these T&Cs is declared null and void or annulled by application of a law or regulation or by any competent authority, such provision or clause shall be deemed not to be in force, the contract remaining in full force and effect between the parties with respect to the other clauses, and shall be interpreted in accordance with the contractual intent expressed by the parties in this document.

11. Exercise of the right of withdrawal Form

In accordance with the provisions of the Consolidated Text of the General Law for the Defence of Consumers and Users RD 1/2007, of 16 November, Consumers may exercise their right of withdrawal within 14 calendar days from the date of contracting.

In accordance with this regulation, the withdrawal period will be extended to 12 months if the company has not complied with its duty to provide information and documentation on this right.
